These Terms & Conditions ("Terms") govern your access to and use of KazTrack("KazTrack", "we", "us", or "our"), including our website and application (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
KazTrack is a GitHub-native project-management and delivery workspace that lets teams plan sprints, track pull requests and issues, log working time, run QA, and automate work through an MCP server. Features may change, be added, or be removed over time.
2. Accounts
- You must provide accurate information and are responsible for activity under your account.
- You are responsible for keeping your credentials, API tokens, and GitHub personal access tokens (PATs) secure.
- You must be at least 16 years old and able to form a binding contract.
3. Acceptable use
You agree not to:
- Use the Service unlawfully or to infringe others' rights;
- Attempt to breach, probe, or disrupt the Service or its infrastructure;
- Reverse engineer or resell the Service except as permitted by law;
- Use the Service to abuse, overload, or violate the terms of any connected third-party service (including GitHub).
4. Third-party services and the GitHub API
KazTrack depends on third-party services to function — most importantly theGitHub API, and optionally Laravel Forge, xCloud, and our payment provider. Your use of these services is also subject to their own terms.
GitHub API limits and availability are controlled by GitHub, not by KazTrack.GitHub imposes rate limits and may throttle, change, deprecate, restrict, or interrupt API access at any time and at its sole discretion. As a result, syncing, label updates, PR comments, imports, or other GitHub-dependent features may be delayed, rate-limited, temporarily unavailable, or fail.These limits and any resulting delays, errors, data discrepancies, or downtime are outside our control, and KazTrack is not responsible or liable for them, nor for the accuracy or availability of data provided by GitHub or any other third-party service.We will make reasonable efforts to handle rate limits gracefully, but we do not guarantee uninterrupted GitHub connectivity.
5. Subscriptions, billing, and cancellation
- Plans. The Service offers a Free plan (one project) and a Pro plan billed per project at $49 per month. Plan features and prices may change with notice.
- Payments. Paid subscriptions are processed by Paddle, which acts as the merchant of record and handles billing, taxes, and invoices.
- Renewal. Subscriptions renew automatically each billing period until cancelled.
- Cancellation. You may cancel at any time; access to paid features continues until the end of the current billing period. Except where required by law, payments are non-refundable.
6. Your content
You retain ownership of the content and data you create or import ("Your Content"). You grant us a limited license to host, process, and display Your Content solely to operate and improve the Service, including syncing it with GitHub at your direction. You are responsible for having the rights necessary to use Your Content and to connect any repositories.
7. Intellectual property
The Service, including its software, design, and trademarks, is owned by KazTrack and protected by law. These Terms do not grant you any rights to our intellectual property except as needed to use the Service.
8. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will operate in combination with any third-party service (including GitHub) without delay or failure.
9. Limitation of liability
To the maximum extent permitted by law, KazTrack and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of the Service or any third-party service, including any GitHub API limits, outages, or changes. Our total liability for any claim will not exceed the amount you paid us for the Service in the twelve months before the claim.
10. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or to protect the Service. Upon termination, your right to use the Service ends; some provisions (such as ownership, disclaimers, and limitation of liability) survive.
11. Changes to these Terms
We may update these Terms from time to time. We will post the updated version here and revise the "Last updated" date. Continued use of the Service after changes take effect constitutes acceptance.
12. Governing law
These Terms are governed by the laws of the jurisdiction in which KazTrack operates, without regard to conflict-of-laws rules. Courts located there will have exclusive jurisdiction over disputes, except where prohibited by law.
